Spittle is an organization dedicated to helping people worldwide reconnect with their immediate surroundings in real-time. Our mission is to assist you in discovering various types of local content, encouraging real-world connections. We want to be very clear about what it means for you to be part of the Spittle community.
To this end, we have created these Terms of Service (“Terms”), our Privacy Policy, and our Community Standards (collectively, the “User Agreement”). In this User Agreement, certain words have specific meanings and must be interpreted consistently, regardless of where they are used. If anything is unclear, please feel free to contact our team.
As founders of Spittle, we hold ourselves to a standard of transparency towards our users.
If you do not wish to read or accept the User Agreement, do not use our Services, but if you use our Services, you agree to be bound by the User Agreement.
These Terms and Conditions (the “Terms”) govern your access to and use of the services, applications, websites, and software (collectively, the “Services”) provided by Spittle SAS, a company located at 4 Impasse du Golf, Biarritz, FRANCE, and registered under number 928 900 505 at the Tribunal de Commerce de Bayonne and Companies Register (“Spittle,” “we,” “our,” or “us”). By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and our Community Standards.
You must be at least 15 years old to use our Services. If you are under 15 (or the minimum age requirement in your jurisdiction), you may not use the Services.
To create an account with Spittle, you must provide accurate and up-to-date information, including your location, email, date of birth, and username. You may also choose to provide additional information such as your first name, last name, phone number, biography, and profile picture.
You are responsible for maintaining the confidentiality of your account and password and agree to notify Spittle immediately of any unauthorized use of your account. Spittle cannot be held liable for any loss or damage resulting from your failure to comply with this obligation.
Content refers to profile pictures, photos, videos, emojis, captions, comments, or messages shared through our Services, including “Stickies,” which are small “stickers” shared on the map and visible to all. You are responsible for the Content you share via our Services, which means ensuring you have the right to use the Content and that it complies with laws, rules, regulations, and the User Agreement.
If you share Content for which you do not own the rights or that violates laws, rules, regulations, or the User Agreement, we have the right to remove it, and we will do so. No claims can be made against us for this action.
We do not tolerate harassment, bullying, defamation, threats, hateful content, sexual exploitation, sexual abuse, promotion of suicide or self-harm, intellectual property theft, or any other illegal activities. For more information, please refer to our Community Standards, which are part of the User Agreement.
You own the Content you share through our Services and grant Spittle the right to use your Content under the following conditions: You retain ownership of the Content you post on Spittle (the “Content”), including photos, videos, messages, stickies, comments, and other information. By sharing it with everyone on Spittle and in exchange for our Services, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, copy, reproduce, process, adapt, edit, publish, transmit, display, and distribute the Content you share as globally shared Content on all media and by all distribution methods. This license allows us to make your globally shared Content available to the rest of the world and allow others to do the same. You acknowledge that this license includes the right for Spittle to provide, promote, and improve our Services and to make the globally shared Content available to other companies, organizations, or individuals for syndication, broadcast, distribution, promotion, or publication on other media and services. These additional uses by Spittle or other companies, organizations, or individuals are made without any compensation to you for the globally shared Content since your use of our Services is considered sufficient compensation.
On Spittle, you can send messages, take photos and videos. We call all of the things you can do on Spittle “activity.” We collect your activity and information you provide, such as:
While you interact with the app, we do share to other connected users when you receive, view or like their content, mainly to provide real-time in-app feedback to content creators.
We are not obligated to monitor the Content users share through our Services. However, we are committed to making our Services a space where people can safely share their local content and experiences. Any Content that violates the rights of others or does not comply with laws, rules, regulations, or the User Agreement (“Non-Compliant Content”) is prohibited. If you come across Non-Compliant Content, you can report it to us using the reporting tools in the app or via the form on our website.
You agree to abide by our Community Standards, which prohibit the posting of illegal, defamatory, obscene, threatening, harassing, or harmful content, as well as impersonation and infringement of others’ intellectual property rights. Spittle reserves the right to remove any Content or suspend or terminate your account in case of violation of these standards.
You agree to use our Services only for lawful purposes and not to interfere with or disrupt the Services or servers and networks connected to the Services.
Spittle reserves the right to modify, suspend, or discontinue, temporarily or permanently, your account and prevent you from using our Services if we determine that you have shared Non-Compliant Content or used our Services in a manner that infringes the rights of others or violates laws, rules, regulations, or the User Agreement.
Please note that some Non-Compliant Content (e.g., content related to child sexual abuse material (CSAM)) will result in your immediate and permanent suspension from our Services. You can contest this suspension by contacting us via our support form.
To protect you, other users, and our Services, we may temporarily suspend your account if we detect unusual activity that could pose technical or security risks to you, other users, or our Services.
Spittle may access, store, and disclose your account information and Content if required by law or if Spittle believes in good faith that such access, storage, or disclosure is reasonably necessary to: (a) comply with a legal process; (b) enforce these Terms; (c) respond to claims that the Content violates the rights of others; or (d) protect the rights, property, or personal safety of Spittle, its users, and the public.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, share, and protect your information. By using our Services, you consent to the collection and use of your information in accordance with this policy.
All rights, titles, and interests in and to the Services, including all intellectual property rights, belong to Spittle or its licensors. You may not use, copy, modify, distribute, sell, or lease any part of our Services or the software included, nor may you reverse engineer or attempt to extract the source code of that software, unless such actions are authorized by law.
To the fullest extent permitted by applicable law, Spittle and its subsidiaries, officers, employees, agents, partners, and licensors shall not be liable for: (a) any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (i) your use of or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
You agree to indemnify and hold harmless Spittle, its officers, directors, employees, and agents, from any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your Content caused damage to a third party.
Spittle reserves the right to modify these Terms at any time. If we make material changes, we will notify you by posting the new terms on our site or through the Services. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
These Terms, along with the Privacy Policy and Community Standards, constitute the entire agreement between you and Spittle regarding the use of the Services.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
The failure of Spittle to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms will be governed by and construed in accordance with French law. You agree to submit to the personal and exclusive jurisdiction of the courts located in Bayonne, France.
