Welcome to Spittle’s Privacy Policy.

We take your data privacy very seriously. Spittle is an organization dedicated to helping millions of people worldwide reconnect with their immediate environment in real-time. Spittle wouldn’t exist without its community of users, which is why we are committed to protecting each member of this community.

This Privacy Policy is part of the User Agreement, which also includes our Terms of Service (“Terms”) and Community Standards.

Through this policy, you can understand exactly what information we collect about you, how we use it, when we share it, and the controls we put in place for the handling of the information you share with us. In this User Agreement, certain words have specific meanings and should be interpreted the same way regardless of their usage.

1. What types of data do we collect?

The term “Information” refers to data that may include, but is not limited to, personal data.

Spittle collects information that you share with us directly (data you provide to us) and also in the context of your use of our services (data we collect through your use of our services).

1.1 Data you share with us

Account Creation Data: This includes data necessary to create an account without which we cannot offer you our Services. This includes:

  • Your location, email, date of birth, and a username.

When creating an account, you can also choose to provide additional information such as:

  • Your first name and/or last name, phone number, biography, profile picture.

Content Data: We receive the content (as defined in the Terms) you create when you use our Services. This includes:

  • Profile picture, username, emojis, captions, comments, messages, and geolocations.
  • “Stickies”: these temporary “stickers” you share on the map to inform the user community about deals or activities around you. They can take the form of photos, images, videos, or texts.
  • Your favorited tags.

Keep in mind that other users can copy (e.g., by taking a screenshot) your Content and share it through other services. Therefore, we advise you not to share Content that you do not want others to see or copy.

Communications with Spittle: When you report an issue with our services, respond to a survey, request help, or exercise your rights, we receive information from you necessary to assist you, respond, and improve our services. This includes:

  • Message content, photos, identifiers (e.g., phone numbers or email addresses), or other information.

1.2 Data we collect through your use of our Services

Like all Internet services, when you use our Services, we automatically receive information about you through your device and your use of our Services:

Technical and Connection Data: IP address, account creation date, last connection, device, and connection point.

Interaction Data: Users you follow, the number of users followed, reactions, comments you leave on content shared by others, users you interact with, messages you send on chat, functional data related to comments or messages.

Usage Data: Actions performed, including the use of Stickies, the time of publication, the number of Sticky publications, the location of Stickies and messages, content viewed, interactions with content, deletions, blocking, masking, screenshots, app crashes, and event logs.

Device and Equipment Data: Device type, operating system version, preferred language, and applications.

We also receive data when you choose, if you wish, to use certain features of our services:

Cameras and Photo Gallery: You can create an account and view Content without allowing us to access and collect data from your device’s camera or photo gallery. However, if you do not grant us this access, you will not be able to share content. Spittle relies on this principle.

Geolocation Data: Spittle is constantly evolving. We create many features related to your experience of the world, the people in it, and the events or activities around you. For our Services to function fully, we need access to your location and recent location history (for security reasons, to prevent abuse and impersonation) when you are on Spittle. You provide this via the authorization settings on your phone. We collect your location using methods that include GPS, wireless networks, cell towers, Wi-Fi access points. We use this range of data sources so that you can view Content around you, up to a maximum radius of 20km. Your exact geolocation is not shared with other app users, only the exact geolocation of the content (messages and stickies) you choose to share is. Your profile is not geolocated but will be visible as connected within the radius you choose to set, between 100m and 20km.

Directory Data: You can choose to allow Spittle to access your contact directory to invite your contacts to use Spittle. We will not access your Directory without your permission. Your contacts’ information will not be used for any other purposes.

Partner Integrations: When you choose to connect to a partner application to use a particular integration on Spittle, we receive information that allows us to offer you this feature. This includes all necessary device data and other optional data you may choose to share as part of this integration.

2. How do we use your data?

We are strongly opposed to selling our information, so we have no intention of selling yours. We use your information carefully and thoughtfully to provide you with our Services.

We can provide you with our services thanks to a variety of software and technical infrastructures. Information is used by various parts of the system to provide you with the necessary features for the proper use of Spittle. Generally, Spittle uses the information it receives for the following purposes:

Legal Bases for Processing We process your personal data based on the following principles:

  • Consent: When you have given your explicit consent for the processing of your data for one or more specific purposes.
  • Contractual Necessity: When processing is necessary for the performance of a contract to which you are a party or for pre-contractual measures taken at your request.
  • Legal Obligations: When processing is necessary to comply with a legal obligation to which we are subject.
  • Legitimate Interests: When processing is necessary for the purposes of the legitimate interests pursued by Spittle or by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms.

Processing Purposes

  • Operation, Improvement, and Provision of our Services: Creating your account, receiving and displaying content, identifying content or accounts that may interest you, ensuring our services work properly, and improving these services.
  • Security and Safety: Ensuring your safety and that of other users, the security of our services and our partners, and compliance with applicable laws and regulations.
  • Statistical Studies:
    • Creating anonymous statistical studies: For example, we may look for user groups with similar habits or usage patterns to see if we can improve the user experience of the Services.
    • Registration Statistics: Determining groups, such as country, users of different types of phones, operating systems, etc., that are statistically relevant for various aggregated studies we conduct.
  • Evaluation and Analysis: Assessing the effectiveness of our Services, including app performance (e.g., crashes and their origins), stability, and your use of account and content recommendations.
  • Communications: Sending you communications, including by email, to respond to support requests or to inform you about a feature of our Services.
  • Research: We value concrete feedback from our users as it helps evolve the Service. We may conduct research, inform you, and you can choose to participate or not. If you choose to participate, you may be invited to share information for research or product testing purposes.
  • Notifications: Sending you push notifications to inform you when favorite users or topics you follow post content within your geographic area.
  • Verification: Verifying your identity to prevent fraud or any other unauthorized or illegal activity.
  • Enforcing Terms: Enforcing our Terms of Use and other usage policies.
  • Responding to Requests: Responding to your rights requests.
  • Local Data Storage: Storing your data locally on your phone, so you can open the app and view content faster.

We have published a table that outlines the information we receive about you, the purposes and legal reasons for which we use it, and the retention periods for this information.

3. In what cases do we share your information?

We only share your information when it is necessary to provide our Services or when required by law. Generally, this falls into the following categories:

Spittle Employees and Co-founders: Authorized employees and co-founders of Spittle may need to access your information to provide you with our Services and related support.

Other Users: When you share Content through our Services, it is available to users within the geographic radius you choose (from 100m to 20km) and for the duration you have defined.

Service Providers: To provide you with our services, we work with a limited number of service providers. These partners are responsible for technical support and hosting, sending notifications, user analysis and satisfaction surveys, managing security incidents or fraudulent activity, etc. In our collaboration with these partners, we may need to share your information with them to provide you with our services.

Partner Integrations: When we collaborate with a partner to offer you a feature, we may need to share your information with the partner to integrate this feature into our services.

Legal and Regulatory Obligations: We may occasionally receive legal requests for information about our users, need to proactively share data with authorities when we become aware of certain content on our services (e.g., child pornography or terrorism), respond to fraud or security issues, or protect individuals on our services or elsewhere from harm.

Change of Ownership: In the event of a merger, acquisition, reorganization, or sale of assets, we may need to transfer your information. We will notify you by email if your information is transferred and becomes subject to a different privacy policy.

Aggregated or Anonymized Information: We may share information that has been aggregated or anonymized so that it cannot be used to identify you.

4. What are your rights and how to exercise them?

You have rights over the information you share with us, including:

Right to Access: You can request access to the information we have about you.

Right to Rectification: You can request that we correct any inaccuracies in the information we have about you.

Right to Erasure: You can request that we delete your account and the information we have about you, unless we are required to keep it for legal reasons. You can use this form to proceed with the deletion request.

Right to Restriction: You can request that we restrict the processing of your information.

Right to Data Portability: You can request a copy of your information in a commonly used format.

Right to Object: You can object to the processing of your information for certain purposes.
